1. Acceptance of Terms

By accessing or using DigiPlanter products, services, mobile application, and website (collectively, the "Services") provided by Digisubs Agency ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Services.

2. Description of Services

DigiPlanter is a smart IoT planter system consisting of:

• Hardware Device: An ESP32-based smart planter with built-in sensors (soil moisture, temperature, humidity, light, water level) and automated systems (irrigation, grow lights, ventilation)
• Mobile Application: A React Native app for iOS and Android that provides real-time monitoring, remote control, and AI-powered care recommendations
• Cloud Platform: Backend services that enable data sync, user authentication, plant library, and AI integrations

3. User Accounts

To use the DigiPlanter mobile application, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and account credentials
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

You may sign up using email/password, Google Sign-In, or Apple Sign-In. We support multiple authentication methods for your convenience and security.

4. Use of Service

You agree to use the Services only for lawful purposes. You shall not:

• Attempt to reverse engineer, disassemble, or decompile any part of the DigiPlanter hardware or software
• Use the Services to harm, threaten, or harass others
• Interfere with or disrupt the integrity or performance of the Services
• Attempt to gain unauthorized access to the Services or related systems
• Use the device in environments for which it was not designed (underwater, extreme heat, etc.)

5. Device & Hardware

The DigiPlanter device is designed for indoor use with household plants. Please note:

• The device requires a stable power source and 2.4GHz WiFi connection for full functionality
• The device is not waterproof — do not submerge or expose to rain
• Sensor readings are approximations and should not be used for scientific or commercial agricultural purposes
• Automated watering, lighting, and ventilation are supplementary — monitor your plants regularly

6. Product Warranty

DigiPlanter hardware is covered by a limited manufacturer's warranty for a period of 12 months from the date of purchase. This warranty covers defects in materials and workmanship under normal use conditions. The warranty does not cover:

• Damage caused by misuse, modification, or unauthorized repair
• Damage from water exposure, drops, or extreme environmental conditions
• Normal wear and tear of sensors and components
• Issues caused by third-party accessories or software

7. Intellectual Property

All content, features, functionality, design, trademarks, and technology of the DigiPlanter Services are owned by Digisubs Agency and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services without prior written consent.

8. AI-Generated Content

DigiPlanter uses OpenAI's GPT-4 to generate plant care recommendations and optimal growing conditions. These AI-generated suggestions are provided as guidance only and should not be considered as professional horticultural advice. We are not responsible for any outcomes resulting from following AI-generated recommendations.

9. Limitation of Liability

To the maximum extent permitted by law, Digisubs Agency shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use of DigiPlanter products or services, including but not limited to:

• Plant damage, disease, or death
• Water damage from irrigation system malfunction
• Data loss or service interruption
• Electrical issues arising from device use

10. Termination

We may terminate or suspend your account and access to the Services at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Services will immediately cease.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the app or email. Your continued use of the Services after changes are posted constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Tunisia, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Tunis, Tunisia.
